Today I got a letter in the mail from the Attorney in Robinson telling me that she was so sorry for my loss and all... "As you know, Kathy now needs a new guardian of the person. I understand that you would like to fulfill this role for her. Illinois law places certain restraints on whom can serve as the guardian of a person. If you have been convicted of a felony, then you are GENERALLY disqualified from serving as guardian. In your Crawford County case it appears that you pled guilty to a Class 3 Felony and you are currently undergoing first offender probation for that charge. It is my opinion that this criminal case bars you from serving as Kathy's guardian.
At this point, it looks like the Office of the State Guardian will need to step in as the guardian of Kathy's person. I believe that Kathy's Guardian as Litem, Rusty Reinoehl, will be petitioning the court for their appointment.
